My hard drive won’t spin up. However, my computer is still under warranty. Unfortunately, it has some software acquired through questionable means, Am I safe sending it back to Dell for recovery?
Dell IS a member of the Business Software Alliance.

1I dont’ think Dell cares about the software you have on the disk.
But if you send it in for repair, you most likely will loose the data on the disk anyway.
They can also send you a completely different disk, even a already used one (refurbished).
However, to get in replaced under warranty, you will have to deal with that.
Always make backups of your data
